Reference is made to MAAG’s announcements dated 5 July 2021, 8 July 2021, 5 August 2021, 23 September 2021, 27 September 2021, 29 September 2021, 15 October 2021, 1 December 2021, 16 December 2021, 31 December 2021, 4 January 2022, 6 January 2022, 18 February 2022, 11 March 2022, 25 April 2022, 17 June 2022, 26 August 2022, 23 November 2022, 30 November 2022, 10 February 2023, 24 March 2023, 27 March 2023, 30 March 2023, 19 April 2023, 19 May 2023, 21 June 2023, 18 September 2023, 11 October 2023 and 21 March 2024 regarding the Writ dated 3 July 2021 filed by Empire Holdings Limited (“Empire”) against MAAG at the High Court of Malaya at Kuala Lumpur.

 

Unless otherwise stated, the terms stated herein shall have the same meaning as defined in the announcements.

 

Today was fixed for the hearing at the Court of Appeal, for the Court of Appeal Case No.: W-02(NCC)(W)-511-03/2023 (“Main Suit Appeal”) and Case No.: W-02(IM)(NCC)-441-03/2022 (“Order 14A Appeal”), wherein parties appeared before the panel of the Court of Appeal to record the Consent Judgment between Empire, MAAG, Tunku Dato' Yaacob Khyra, and Turiya.

 

The Court of Appeal panel comprised of the following Judges:

  1. Yang Arif Datuk Ravinthran N. Paramaguru;
  2. Yang Arif Dato' Sri Mariana Binti Haji Yahya; and
  3. Yang Arif Dato' Lim Chong Fong.

The Consent Judgment was entered between parties to record the following:-

  1. withdrawal by Empire of the Main Suit Appeal and of the Order 14A Appeal against MAAG, Tunku Dato' Yaacob Khyra, and Turiya, without liberty to file afresh; and
  2. no order as to costs against Empire in the Main Suit Appeal and in the Order 14A Appeal.

The Court of Appeal recorded the Consent Judgment between Empire, MAAG, Tunku Dato' Yaacob Khyra, and Turiya for the Main Suit Appeal and for the Order 14A Appeal.

 

Accordingly, the Court of Appeal dismissed the Main Suit Appeal and the Order 14A Appeal against MAAG, Tunku Dato' Yaacob Khyra, and Turiya.

 

MAAG was represented by its solicitors, Messrs. Deol & Gill.

 

MAAG will make the necessary announcements as and when there are material developments, or upon receiving any direction or order from the Court of Appeal.
