Reference is made to the Company’s announcements dated 27 June 2023, 25 July 2023, 4 October 2023 and 25 October 2023 (“Announcements”). Unless otherwise defined in this announcement, all defined terms used herein shall have the same meaning as those defined in the Announcements.
The Board of Directors (“the Board”) of the Company wishes to announce that on 11 March 2024, the matter below was fixed for hearing:-
(a) Enclosure 7
This is an application by the Plaintiff for mareva injunction. The Court has dismissed the application for mareva injunction with costs of RM5,000.00 to be paid by the Plaintiff to the 1st Defendant and the 3rd Defendant.
(b) Enclosure 10
This is an interpleader application by the 3rd Defendant for the Court direction on the stakeholder money of RM3,000,000.00 either to be placed on joint current account by the Plaintiff and the 1st Defendant and/or to be paid to the Court. Upon submission of the parties, the Court has directed the RM3,000,000.00 to be released to the 1st Defendant.
(c) Enclosure 32
This is an application by the 2nd Defendant to strike out the suit. The Court has dismissed the application with costs in the cause.
As for the main suit, the Court has fixed the matter for full trial on 16 until 20 December 2024. The Court further directed parties to file the following:-
(a) bundle of pleadings (b) common bundle of documents (c) issues to be tried (d) agreed facts
The matter was fixed for next case management on 15 May 2024.
