We refer to our announcements dated 14 April 2021, 16 April 2021, 28 April 2021, 4 June 2021 and 20 November 2023 (“Announcements”) in respect of the above.
For consistency purposes, the abbreviations and definitions used throughout this announcement are the same as those previously defined in the Announcements.
The Board wishes to update that TMD’s Solicitors had on 6 February 2024 informed the Company that pursuant to a Motion for Leave to Appeal at the Federal Court by ING Bank and OWB, the Federal Court had given the following directions in the case management held on 5 February 2024:-
a) written submissions, common core bundle and executive summary (if necessary) to be filed by 15 May 2024;
b) a case management on 16 May 2024 to monitor the filing of documents for the hearing on 16 May 2024;
c) hearing on 30 May 2024.
TMD’s Solicitors had also informed the Company that a case management has been fixed on 20 February 2024 to fix a hearing date for an application to stay the proceedings in the High Court pending the decision of Federal Court.
The Company shall continue to make announcement on the material development of the case from time to time accordingly.
