1. This announcement is to provide a further update to Item 21-Material Litigation as contained in the Company’s Quarterly report on consolidated results for the financial period ended 30 June 2023 duly announced on 25 August 2023 (Reference Number: FRA-25082023-00029) (“QR-0623 Announcement”), and the subsequent announcement of the Company made on 01 September 2023 (Reference Number: GA1-01092023-00019) (“Announcement-010923”).
2. Unless otherwise stated, the abbreviations and definitions used throughout this announcement shall have the same meanings as those previously defined in Item 21-Material Litigation of the QR-0623 Announcement, and the Announcement-010923.

On 25 September 2023, the Company received the Notice of Appeal dated 21 September 2023, filed by Leong Tat Yan (also referred to as “Appellant”) to the Court of Appeal of Malaysia on the decision of the High Court on 30 August 2023, appealing against the whole of the decision wherein the Respondents’ claim was allowed and the Appellant’s counterclaim was dismissed as follows:

1. sum of RM946,496.39 to be paid by the Appellant to the First Respondent;
2. sum of RM3,303,671 to be paid by the Appellant to the First Respondent;
3. sum of RM2,249,751.08 to be paid by the Appellant to the Second Respondent;
4. sum of RM14,871,167.03 to be paid by the Appellant to the Second Respondent;
5. Interest on the sums referred to in paragraphs (1) to (4) above at the rate of 5% per annum from the date of judgment to the date of full realization, to be paid by the Appellant to the Respondents;
6. The Appellant’s counterclaim is dismissed; and
7. costs of RM100,000.00 to be paid by the Appellant to the Respondents within 30 days from the date of judgment, subject to allocatur.
